It would be, except the Europe Region
EULA is different from the North America Region
EULA, and seems among other things to be missing the part regarding the "Consent to Monitor" which is precisely the one of interest here. This would be because many European Countries have stronger laws concerning the protection of users privacy (CNIL law nš78-17 in France for example) which would conflict with a stronger monitoring.
So still waiting an answer for the US Region I guess
