Hosting services are not responsible for policing their clients content. They are, however, responsible for what is on their servers. A hosting company does not own the server outright. They lease it from a data center who in turn has their own ToS/AUP. It is the hosting companies responsibility to follow those ToS/AUP, and I can guarantee that most, if not all, have something in there about copyrighted material. I know my data center does.
