If you notice, most of the so-called "Date Rape" drugs are in schedules III and IV, as are several opiates and prescription painkillers, as well as a cousin of LSD known as LSA.
So there we go, clearly this is not a marijuana charge. It is worth noting however that marijuana is Schedule I which appears to mean that they think marijuana is more dangerous that whatever he was dealing with (which I think is more than a little screwy, but that's a whole different topic).

The sentencing for certain drugs depends on if its state or federal, if its state it also depends on what state.

The position of Marijuana on the Schedules has long been an object of debate - most people think it should be listed on IV at most, if not completely removed from the act (by the general definitions of each Schedule, it should be, at most, a III or IV). But that's a conversation for an entirely different thread.
