Not true. You can download the game (both regular and TBC) without buying anything or having any account at all. You just need either the torrent files or the Blizzard downloaders (full versions, not stream-as-you-play). Of course to actually play the game you need an account (even during the free trial period). But you may even download the client from any region and play in a different region (where your account is) afterwards.

Aren't Private servers computers where someone has HACKED/STOLEN the software and uses it to steal registered user's accounts? That has been my experience with them in the past. Even if they aren't stealing your account it's still breaking the law.... unless I totally misunderstand what you're suggesting.
