If it's your code from scratch, it's your addon and as such not subject to copyright infrigement.
If it's someone elses code modified to your liking, it's usually okay with just asking for permission to distribute it. If he/she says it's okay, go for it. Otherwise, refrain from uploading. Hope this helps!
